1. About Our Courses
Intelligensa Limited provides online training courses and, where specified, blended learning and practical training programmes.
Course descriptions, content, prices, access periods, prerequisites and completion requirements will be set out on the relevant course sales page.
It is your responsibility to review the course description and ensure that the course meets your requirements before purchasing.
Some courses may require additional practical training, assessments or other activities before a certificate can be issued. These requirements will be explained in the relevant course information.
2. Purchasing a Course and Payment
Payment must be made in full at the time of purchase unless an alternative arrangement has been expressly agreed in writing by Intelligensa Limited.
Course prices will be displayed on the relevant sales page. Any applicable VAT or other charges will be shown before you complete your purchase.
Your purchase will be processed through the Thinkific platform and its applicable payment services. You must provide accurate information when placing your order.
Access to the course will normally be provided once payment has been successfully processed. We reserve the right to withhold access where payment has not been received or where a transaction is suspected of being fraudulent.
If you are purchasing a course on behalf of an organisation, you confirm that you are authorised to make the purchase and agree to these Terms and Conditions on its behalf.
3. Course Access and Account Security
Course access is provided through our Thinkific learning platform.
Unless otherwise stated on the course sales page, access is granted to the individual who purchased or was registered for the course. Login details must not be shared with other people.
You must not:
Share your account or login credentials with another person.
Allow another person to complete the course using your account.
Copy, distribute, sell or otherwise share course materials or restricted course content.
Attempt to bypass access controls or interfere with the operation or security of the learning platform.
You are responsible for maintaining the confidentiality of your login details and notifying Intelligensa Limited promptly if you suspect unauthorised access to your account.
Course access is limited to the period stated on the relevant sales page. Where no specific access period is stated, the access arrangements will be confirmed by Intelligensa Limited before or at the time access is provided.
We may suspend or withdraw access where there is a reasonable basis to believe these Terms and Conditions have been breached. Where appropriate, we will notify you and provide an opportunity to resolve the issue. This does not affect any statutory rights you may have.
4. Cancellations, Refunds and Consumer Rights
4.1 Your statutory cancellation rights
If you purchase a course as a consumer online, you will generally have a legal right to cancel your purchase within 14 days of entering into the contract, subject to the applicable consumer legislation and the exceptions explained below.
If you wish to cancel within this period, please contact us at the earliest opportunity, clearly stating your intention to cancel and providing your order details.
Where you validly cancel within the applicable period, any refund due will be processed in accordance with the law.
4.2 Immediate access to digital content
Our online courses may include digital content such as videos, presentations, documents, assessments and other learning resources.
If you ask us to provide access to digital content immediately, before the end of the 14-day cancellation period, we will ask you to provide the necessary express consent and acknowledgement at checkout.
Where the legal requirements have been met, your statutory right to cancel may be lost once supply of the digital content begins.
If the required consent and acknowledgement have not been obtained, your statutory cancellation rights will not be removed merely because you have accessed the course.
4.3 Refund requests outside the statutory cancellation period
Once the applicable statutory cancellation period has expired, a change of mind, failure to complete the course or lack of time to undertake the training will not ordinarily entitle you to a refund.
However, we will consider refund requests on a case-by-case basis where appropriate. This does not affect your rights where the course or digital content does not conform to the contract or where you have another legal entitlement to a refund or other remedy.
Nothing in these Terms and Conditions excludes or restricts your statutory rights.
4.4 Courses including practical training or scheduled sessions
Where a course purchased through Thinkific includes scheduled practical training or instructor-led sessions, the following cancellation charges may apply to cancellations made by the customer or sponsoring organisation, subject to applicable statutory rights and the requirement that the charges are fair and proportionate.
More than 28 calendar days before the course start date: 0% of course fees.
22–28 calendar days before the course start date: 25% of course fees.
15–21 calendar days before the course start date: 50% of course fees.
8–14 calendar days before the course start date: 75% of course fees.
7 calendar days or less before the course start date: 100% of course fees.
These charges apply to the scheduled practical or instructor-led element of the course and do not override any statutory cancellation or refund rights that apply to the purchase.
5. Course Participation and Completion
You are responsible for ensuring that you have the time, equipment, internet access and other facilities reasonably required to participate in the course.
You must complete the course activities, assessments and any other requirements specified in the course description before a certificate of completion can be issued.
Where a course includes practical training or an assessment, attendance at or completion of the online modules alone may not be sufficient to qualify for certification.
Intelligensa Limited may withhold a certificate where the required course components have not been completed or the required standard has not been achieved.
You must not misrepresent your course attendance, completion, assessment results or qualifications.
6. Technical Requirements and Platform Availability
You are responsible for ensuring that your device, browser, internet connection and software are compatible with the Thinkific platform and the course requirements.
We will take reasonable steps to make course content available, but we cannot guarantee uninterrupted access at all times. Temporary interruptions may occur due to maintenance, technical issues, internet connectivity problems or circumstances outside our reasonable control.
If you experience a technical problem affecting your access, please contact Intelligensa Limited so that we can investigate and, where appropriate, assist you.
Where a significant problem attributable to us prevents you from accessing the course you purchased, we will consider an appropriate remedy in accordance with these Terms and Conditions and your statutory rights.
7. Medical, Physical and Practical Training Requirements
Some Intelligensa courses relate to physical intervention, positive handling, personal safety or other practical activities.
Unless the course is expressly designed and advertised to provide practical instruction, an online course must not be treated as practical competence training.
Delegates participating in practical training must be able to read and write in English, or have a suitably qualified interpreter where this is permitted and appropriate for the course.
Where practical participation is required, delegates must comply with the relevant medical screening, health and safety requirements, clothing requirements and instructions provided by the trainer.
Delegates should seek appropriate medical advice if they are unsure whether they can safely participate in practical activities. Relevant medical information must be disclosed where required for safe participation.
Intelligensa Limited may restrict or exclude a delegate from practical activities where reasonably necessary for health and safety reasons. Any resulting arrangements, including the opportunity to complete the course at a later date, will be considered in accordance with the applicable booking terms and the circumstances.
Online course completion does not, by itself, establish that a person is competent to perform practical physical intervention techniques.
8. Certificates and Qualifications
Where a certificate is offered, it will be issued only when the relevant course completion and assessment requirements have been met.
Certificates may confirm completion of an online learning course only. They must not be represented as confirming practical competence, professional registration, an accredited qualification or approval to deliver training unless this is expressly stated and supported by the relevant course and certification arrangements.
Completion of an Intelligensa course does not automatically qualify an individual to deliver physical intervention training, become an Intelligensa Affiliate or deliver training certified against the Restraint Reduction Network (RRN) Training Standards.
Any additional trainer approval, practical assessment, organisational approval or certification requirements will remain applicable.
Certificates will normally be issued electronically or by another method specified for the relevant course.
9. Intellectual Property and Use of Course Materials
All course materials supplied by Intelligensa Limited, including text, presentations, videos, graphics, documents, assessments, training models and other learning resources, remain the intellectual property of Intelligensa Limited or the relevant rights holder.
Purchasing a course grants you a limited, personal, non-transferable right to access and use the materials for your own learning during the permitted access period.
Unless we have given prior written permission, you must not:
Reproduce, copy, record, download where not expressly permitted, publish or distribute course materials.
Share course materials or login details with colleagues, other organisations or third parties.
Use course materials to deliver training to others or for commercial purposes.
Adapt, sell, sublicense or create derivative training materials from our content.
Remove copyright notices, branding or other intellectual property notices.
Any separate licence to use Intelligensa materials for organisational training or delivery purposes must be agreed in writing.
Unauthorised use may result in the suspension of access and may lead to further action where appropriate.
10. Confidentiality and Data Protection
You must respect the confidentiality of any personal, sensitive or confidential information encountered during the course. You must not disclose such information to third parties without a lawful basis or appropriate authorisation.
Where a course involves case studies, scenarios or discussions relating to real individuals or organisations, you must not disclose identifiable information unless expressly authorised and lawful.
Intelligensa Limited will handle personal information in accordance with applicable data protection legislation and our Privacy Policy.
Thinkific and relevant payment service providers may process information as necessary to provide the learning platform and process transactions. Further information about how personal data is used and protected is available in our Privacy Policy.
11. Photography, Recording and Sharing
You must not record, photograph, reproduce or redistribute course videos, live sessions, assessments or other course content without prior written permission from Intelligensa Limited and any other relevant rights holder.
Where a course includes live or practical training, any photography or video recording by Intelligensa Limited will be undertaken only where appropriate permissions and arrangements are in place.
12. Course Changes, Withdrawal and Unforeseen Circumstances
We may make reasonable changes to course content, presentation or delivery where necessary to maintain quality, improve learning or respond to changes in law, guidance or professional standards.
We will not use this right to make a significant change that materially reduces the course purchased without considering an appropriate remedy where required by law.
If we are unable to provide a course, or a significant part of it, we will notify affected purchasers and consider an appropriate alternative, replacement access or refund in accordance with the circumstances and applicable law.
Where a course includes scheduled practical training, a session may need to be postponed due to trainer illness, travel disruption, adverse weather, venue problems or other unforeseen circumstances. We will make reasonable efforts to arrange a suitable alternative. Any refund or rescheduling arrangements will be dealt with under the terms applicable to that course and your statutory rights.
13. Liability
We will exercise reasonable care and skill in providing our courses.
Our courses are intended for education and training purposes. Unless expressly stated otherwise, they do not constitute legal, medical or other professional advice tailored to your particular circumstances. You remain responsible for applying relevant law, guidance, policies and risk assessments to your own role and working environment.
Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights or remedies that cannot legally be excluded or restricted.
Subject to the above, Intelligensa Limited will not be responsible for losses that are not reasonably foreseeable or for losses caused by circumstances outside our reasonable control.
14. Complaints and Contact
If you have a concern about a course, your access, a payment or these Terms and Conditions, please contact us as soon as possible so that we can investigate and seek to resolve the issue.

15. General Terms
If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure or delay by Intelligensa Limited in enforcing a provision does not mean that we waive our right to enforce it later.
These Terms and Conditions, together with the course description and any additional terms expressly provided before purchase, form the agreement between you and Intelligensa Limited in relation to the course purchased.
If there is any inconsistency between these Terms and Conditions and specific terms clearly presented for a particular course before purchase, the specific course terms will apply to the extent of that inconsistency, subject always to applicable law.
These Terms and Conditions are governed by the laws of England and Wales, without affecting any mandatory consumer protections that apply in the country where a consumer lives.
